본 논문은 빨리율을 중심으로 사미의 악행과 그에 대한 제재 방식을 고찰하여, 승가가 예비 출가자를 어떠한 원칙 아래 교육하고 관리하였는지를 밝히는 것을 목적으로 한다. 빨리율 ｢대건도(Mahākkhandhaka)｣에서는 사미의 악행을 ‘(1)사미십계’, ‘(2)단다갈마의 대상이 되는 다섯가지 행위’, ‘(3)멸빈의 대상이 되는 열 가지 행위’의 세 범주로 설명한다. 그런데 이 가운데 (2)에 대해서는 범계의 내용뿐 아니라 그에 따른 제재 방식까지 설명하고 있는 반면, (1)의 경우 제재 방식에 대한언급이 전혀 없고, (3)의 경우에도 멸빈이 구체적으로 어떠한 제재를 동반하는 처벌인지 알 수 없다. 이에 본고에서는 주석 『사만따빠사디까(Samantapāsādikā)』의 관련 내용을 분석하여 이 세 범주의 악행이 서로 어떠한 관계 속에서 이해되고 제재되는지를 검토한다. 이를 통해 빨리 상좌부의 사미 제재가 ‘단다갈마’와 ‘멸빈’을 중심으로 이루어졌음을 밝히고, 나아가 이들 제재 방식이 참회와 교화를 우선하면서도 공동체의 질서를 중대하게 훼손하는 행위에 대해서는 단호한 배제를 통해 승가의 청정을 유지하고자 하였음을 논증한다.
This study examines the categories of novice (sāmaṇera) misconduct and the disciplinary measures prescribed in the Pāli Vinaya, with the aim of clarifying the principles by which the saṅgha educated and administered novice monks. The “Mahākkhandhaka” section classifies novice misconduct into three categories: (1) Ten Precepts for Novices, (2) five offences subject to disciplinary acts (daṇḍakamma), and (3) ten offences subject to expulsion (nāsanā). While the second category specifies both the offences and the corresponding disciplinary procedures, the first provides no information regarding sanctions for violations, and the third does not explain what expulsion specifically entails. To address these issues, this study analyzes the relevant passages of the Pāli text Samantapāsādikā to examine how these three categories of misconduct are related to one another, how they were sanctioned, and how the novice disciplinary system was structured. Based on the current analysis, I argue that dis-ciplinary measures for novices in the Theravāda tradition is centered on the concepts daṇḍakamma and nāsanā. Furthermore, it demonstrates that this disciplinary system prioritized repentance and moral rehabilitation while preserving the purity of the saṅgha through the decisive exclusion of those whose conduct seriously threatened the harmony and discipline of the monastic community.
